International Humanitarian Law and Justice:Historical and Sociological Perspectives '18
内容
In the last decade, there has been a turn to history in international humanitarian law and its accompanying fields. In parallel historians have deepened their interest in the place of norms of history, the establishment and development of international institutions. This book brings together scholars from various fields, including law, history, sociology and international relations to examine this historization of international humanitarian law. With a focus on international humanitarian law, the work also examines human rights law, international criminal law and the law on the use of force. The book explores four main themes: historiographies of selected fields of international law; evolution of specific international humanitarian law rules in the context of legal gaps and fault-lines; emotions as a factor in international law; and how actors can influence history. In bringing together scholars from various fields, the book expands the current scope of scholarship. This allows readers an improved overview and starting-point for further research.
